It has been 30 years since Perarivalan was taken away in connection with the Rajiv Gandhi assassination case.
It is reprehensible that the House of Governors continues to turn a blind eye to the release of Rajiv Gandhi, who was declared not involved in the Rajiv Gandhi assassination case by the investigating authorities to the judges.
On the night of June 11, 1991, 30 years ago, the CBI's Special Investigation Unit told Perarivalan's parents that they had to hold a small inquiry into the Rajiv Gandhi assassination case.
Investigators promised to send Perarivalan the next morning after the investigation was completed. Accepting it, Perarivalan was sent away by his parents without any fear.
However, the authorities took it as an inquiry to get some explanation about Rajiv's murder, where they distorted the confession given by Perarivalan and added it to the murder case.
Perarivalan and 6 other Tamils who were subsequently convicted and imprisoned in that case have been lodged in jail for 30 years till date.
All 7 Tamils, including Perarivalan, were initially sentenced to death, which was later overturned and commuted to life imprisonment at various stages.
It is a well-known fact that the police officer who interrogated him and the Supreme Court judge who convicted him said that Perarivalan did not commit any crime.
On 09.09.2018, the Cabinet headed by the then Chief Minister Edappadi Palanisamy passed a resolution recommending the release of 7 Tamils in respect of the Supreme Court ruling that the Governor of Tamil Nadu has the power to release Tamils including Perarivalan.
However, the case came to a standstill when the Union Home Ministry told the Supreme Court on 25.12.2020 that the Governor had sent files to them asking the President to decide on the release of 7 Tamils, including Perarivalan, after remaining silent for 871 days. It is the duty of the Government of Tamil Nadu to demolish it and release the seven.
MK Stalin, who took over as Tamil Nadu chief minister last month, had written a letter to the president on May 20 urging him to take a quick decision on the release of seven Tamils.
7 Taking the issue of Tamil emancipation to the President's decision is not only an act of delaying their release, but an act similar to the transfer of state rights to the Central Government.
7 On 07.09.2018, the Supreme Court ruled very clearly that the Governor of Tamil Nadu has the power to release Tamils under Section 161 of the Constitution of India, and we must continue to knock on the doors of the House of Governors in Delhi, not the doors of the House of Representatives in Delhi.
Although the Union Home Ministry said that the Governor had sent them the recommendation of the Tamil Nadu Cabinet regarding the release of 7 Tamils, including Perarivalan, no official announcement had been made by the Governor in this regard.
7 It is the duty of the Governor under Section 161 of the Constitution to review and approve the recommendation made by the Cabinet of Ministers regarding the release of Tamils. He can't shy away from it. He cannot refer the matter to the President.
Therefore, the present Chief Minister Stalin should write a letter to the Governor on the recommendation made by the then Chief Minister Edappadi Palanisamy on 09.09.2018 regarding the release of 7 Tamils. Meet in person and insist.
The Supreme Court should appoint a competent senior advocate concerned with human rights to advocate on behalf of the State of Tamil Nadu in the case pending in the Supreme Court regarding the release of Perarivalan.
It should ensure that his elderly mother and father are happy to see their son, who was imprisoned on the same day 30 years ago, return home free. Let the darkness be removed soon and the light be born '.
