Kasi Vishwanathar Temple is located in Varanasi, which is considered to be the holiest place of Hindus in the state of Uttar Pradesh. Adjacent to its sanctum is the Gyanwabi Mosque of the Muslims. It has been complained for many years that the Kasi Vishwanathar temple was demolished and built by the Mughal emperor Aurangzeb.
The case was filed in the Varanasi District Civil Court in December 2019. District Speedy Trial Judge Ashutosh Tiwari had issued the key order on April 9.
In the order, the Director General of the Archaeological Survey of India (ASI) of the Union Government said that the Gyanwapi Mosque should be inspected for any other religious symbols that may have been altered, with the help of its ruins or if it had been demolished. He also mentioned setting up a five-member team with scientific and archaeological experience.
U.P. opposed this order. An appeal was filed yesterday on behalf of the Sunny Muslim Central Waqf Board. It is said that the Gyanvapi Mosque was built by the Mughal King Akbar without demolishing the Kasi Vishwanathar Temple. Some historical documents have also been submitted as evidence.
The petition, filed in the Varanasi District Civil Court, said, 'This order is in violation of the Special Protection of Religious Symbols Act, 1991 issued by the Central Government. The law was also adopted in the case of Ayodhya by a five-judge bench. Therefore, the Varanasi court has no jurisdiction to issue any order against the Gyanwapi Mosque under this Act. The petition is expected to come up for hearing on the 9th.
