Ramdhass has demanded that the Tamil Nadu Civil Service Selection Board immediately withdraw its appeal in the High Court against the decision to postpone the amendment to provide 20% reservation for those educated in the Tamil way to implement true social justice.
Pmk founder Ramadhass issued a statement today:
'The Tamil Nadu Civil Service Selection Board has appealed against the High Court's decision to implement the amendment which provides for 20% reservation for Person Studied in Tamil Medium (PSTM) only for those who have studied Tamil the entire educational qualification for Tamil Nadu government service. This is the biggest social injustice inflicted on Tamil-educated students in employment.
The law providing for 20% reservation in employment for those educated in Tamil was passed in 2010 under the then DMK regime. However, as graduation is the basic qualification for most jobs in Tamil Nadu, many who have already studied in English from school to undergraduate level are benefiting from 20 per cent reservation in government sector employment after completing only one degree in Tamil by post.
To prevent this, the Proletarian People's Party has been urging for years that the law be amended to make this 20% reservation available only to those who have studied the Tamil way from school to graduation. Following this, a bill was introduced in the Tamilnadu Legislative Assembly on March 16 last year to provide this 20% reservation only to those who have studied in the Tamil way at all levels from school to college.
The law was approved by the Governor of Tamil Nadu after nearly nine months of struggle. On 22.03.2021, the Madurai High Court, hearing a case against the misuse of reservation for Tamil medium students, ruled that the 20% reservation for Tamil medium education should be implemented from the competitive examination for the first batch of DNPSC published on 20.01.2020.
This judgment of the High Court was given with the intention of giving justice to the students who studied in the Tamil way. Based on this ruling, it would be appropriate to give reservation to those who have studied in the Tamil way in the competitive examination announced for the selection of 69 first batch officers including 18 Deputy Collectors and 19 Assistant Superintendents of Police to the Government of Tamil Nadu.
Instead, the Civil Service Selection Board has appealed to the High Court. The reasons given by the selection committee for this are unacceptable. The notice of contest has been issued even before the amendment of the law of the state of Tamil Nadu is passed. The results of the first round of examinations have been announced before the High Court's verdict.
The apex court has said that a section of students will be affected if the Tamil reservation is given under the new rules as the pre-amendment rules were followed in allocating seats for those who studied in Tamil in the first level examination. This is not correct.
The selection committee says that if the new law of the Tamil Nadu government is implemented later, those who study in English till graduation and additionally study a degree in Tamil and try to enjoy Tamil reservation illegally will be affected. The purpose of the new law is to prevent those who abuse Tamil reservation.
As such, it cannot be accepted that the Tamil reservation is being looted by those who have studied in English for the sole reason that the competition has been declared before the date of enactment of the Act. The selection committee should not go for such injustice.
During the period 2016-19, out of the 22 assignments allotted to those who studied in Tamil in the first batch, 11 were studied in English from Class I to Graduation and finally a nominal degree was obtained by those who studied in Tamil by post. This is the greatest social injustice. Such injustice should not be allowed to recur.
According to the new law, if the first batch is selected and the results are announced, a total of 10 batch of posts including 3 District Deputy Collectors, 2 Assistant Superintendents of Police, 3 Co-operative Deputy Registrars and 2 Assistant Directors of Rural Development will be available only to those who have studied in Tamil from Class I to Graduation.
That will be the real social justice and Tamil justice. In order to ensure that, I urge the Tamil Nadu Civil Service Selection Board to immediately withdraw the appeal filed in the High Court against the decision to postpone the amendment of the Act to provide 20% reservation for those educated in the Tamil way.
Thus Ramadhass insisted.
